Disclosure and Barring Service (DBS) Code of Practice

When the licensing authority processes applications that require an Enhanced Disclosure and Barring Service (DBS) check, it must comply with the DBS Code of Practice. This Code sets out the standards that all registered organisations must follow when handling criminal record information.

The Code of Practice is issued by the Disclosure and Barring Service (DBS) and is designed to make sure that sensitive personal information is used fairly, lawfully, and securely.

What this means for applicants

When you apply for a licence that requires an Enhanced DBS check, the licensing authority will:

  • Use your DBS information only for its intended purpose
    DBS certificate information will be used solely to assess your suitability for the specific licence or role applied for.

  • Treat your information fairly and lawfully
    Decisions will be made in line with relevant legislation, Council policy, and safeguarding responsibilities.

  • Handle your information securely
    All DBS-related information is stored securely and access is strictly limited to authorised officers who need the information to carry out their duties.

  • Keep information only for as long as necessary
    DBS certificate information is retained for the minimum period required and then securely destroyed in line with the Code of Practice and data protection legislation.

  • Respect your rights
    You have the right to be treated fairly and to raise concerns if you believe DBS information has been misused.

Data protection and confidentiality

The licensing authority must also comply with data protection legislation when handling DBS information. This includes ensuring that personal data is accurate, kept up to date, and protected against unauthorised access or disclosure.

DBS certificates are confidential documents. Applicants are encouraged to keep their certificate safe and to share it only where required by law or licensing conditions.
